I am a licensed Real Estate Professional. I am an independent contractor in a Real Estate Brokerage. In addition, I have chosen to belong to the local, state and national Realtor’sŪ Associations and I choose to abide by their Code of Ethics with its Golden Rule obligations to clients, to the public and to other RealtorsŪ.
I am compensated for my service through a negotiated brokerage agreement with the seller or the buyer, with both the seller and the buyer (disclosed to both parties) or with a third party. Compensation agreements must be in writing and are often a percent of the final negotiated purchase price.
As a member of the WCAR Multiple Listing Service (MLS), I can access other Brokerage listings through a co-brokerage agreement. Sellers usually request this cooperative form of marketing. Through the MLS, listing agents offer compensation to MLS members for representing buyers in the sale of these properties. Properties sold in our market are usually on the MLS.
Properties “For Sale” but not offered through a Real Estate Brokerage are often called For-Sale-By-Owner (FSBO). I may represent you on the purchase of a FSBO. You and I will negotiate the brokerage compensation in writing prior to providing service and representation on FSBO properties (a Buyer’s Agreement). I may also represent you in researching and offering to purchase properties which are not currently for sale.
If I represent the seller on a property that you wish to purchase, and if both you and the seller give me permission in writing, I may proceed to represent both of you on the transaction. This is called dual agency. I may not do harm to either party and I must keep the confidences of both sides.
I must provide you with The Law of Real Estate Agency before you sign any contract and I must provide you with a copy of a Lead Based Paint brochure which provides information on how to protect yourself and your family if you choose to purchase a property built on or before 1978.
If you are interested in seeing a property in a builder’s development, please talk with me first. There are often rules about first contact (i.e. if you go directly to the developer, you may have to pay separately if you want independent representation in a transaction).
